The Regulation on Work Permits ( “Official Gazette of the Republic of Serbia”, No. 63/18), entered into force on 25.08.2018. On the date of entry into force of this regulation, the Regulation on Work Permits (Official Gazette of the Republic of Serbia, No. 94/15 and 9/18) ceased to be valid. The Regulation further regulates the manner of issuing or extending a work permit, the manner of proving compliance with the conditions and the necessary evidence for issuing or extending a work permit, and the form and content of the work permit.
Depending on the type of work permit being requested, the following requirements are distinguished:
Application for a personal work permit
Application for a work permit for employment
Application for a work permit for seconded persons
Application for a work permit for movement within a company
Application for a work permit for an independent professional
Application for a work permit for training and advanced training
Application for a work permit for self-employment
The application for the issuance or extension of a work permit shall be submitted to the organization responsible for employment affairs at:
The place of temporary stay or permanent residence of the foreigner, in the case of permits issued at the request of the foreigner (personal work permit, or training and advanced training permit when submitted by the foreigner)
The registered office of the employer, in the case of work permits issued at the request of the employer and if the employer is registered in the Republic of Serbia (work permit) employment permit, for seconded persons, for movement within the company and for training and further education when the request is submitted by the employer)
The place where the work is performed (work permit for self-employment and work permit for an independent professional).
The receipt of applications and review of documentation for issuing work permits to foreigners, in the Belgrade Branch, is carried out in office no. 220. every working day from 8 a.m. to 1 p.m.
In accordance with the Law on Republic Administrative Fees (“Official Gazette of the Republic of Serbia”, No. 43/03… 57/14, 45/15-harmonized dinars, 83/2015, 112/2015, 50/2016 – harmonized dinars, 61/2017 – harmonized dinars, 113/2017, 3/2018 – corr. 50/2018 – harmonized dinars), the fee for issuing a work permit is charged under tariff number 205:

NOTE FOR EMPLOYERS:
In the case of submitting an application for a work permit for employment, the National Service is obliged to conduct a labor market test based on the application for employment submitted by the employer.
The procedure is as follows:
The employer submits to the National Employment Service a request for employment mediation for a specific job (PPZ Form), no earlier than 60 and no later than 10 days before the date of issuance of the work permit for employment. The PPZ Form can also be submitted electronically.
Exceptionally, when it is in the interest of the RS or required by internationally accepted obligations, the Minister responsible for employment may set a deadline of less than 10 days for submitting a job application. In that case, the employer is obliged to submit the consent of the Minister responsible for employment, which sets a deadline of less than 10 days.
The National Service shall, within a period of 10 days (or exceptionally, shorter), conduct a labor market test, or employment mediation, and in this way determine whether the unemployment records contain unemployed persons who meet the employer’s requirements for a specific job.
The National Service shall prepare a report on the implementation of the employment need, which shall also be part of the documentation necessary for obtaining a work permit for employment, and shall submit it to the employer.
The employer shall, within 3 days from the date of receipt of the report, submit to the National Service the Form of Notification on Action on the Report on the Implementation of the Employment Need and submit a request for the issuance of a work permit for employment with the necessary documentation.
Exceptionally, when it is in the interest of the Republic of Serbia or required by internationally accepted obligations, a foreigner who has submitted a request for temporary residence and meets all the conditions from the employer’s requirements relating to appropriate knowledge and skills, qualifications and previous experience may be issued, for a period that cannot exceed 45 days, a temporary work permit for employment, with the prior consent of the Minister responsible for internal affairs, which obtained and submitted by the employer-applicant.
